1 Bookings

The following terms and conditions govern the offers of tours proposed by COL CYCLING ADDICTION.

By booking on one of our programs you become a non-voting member of the COL CYCLING ADDICTION association for a period of 3 years, and agree to abide by our general and specific conditions of sale.

It is essential to consult the technical information sheets before booking, because they provide, among other things, the following information: programme of the tours, technical level and necessary physical preparation, time and place of meeting.

When you book, you must draw the attention of COL CYCLING ADDICTION to any decisive element of your choice, to any particularity concerning you that may affect the progress of the journey or tour, and specify it in detail in writing along with your booking request.

1.1 Booking procedure

COL CYCLING ADDICTION tours are considered, within the meaning of the current regulations as of 1 July 2018, as package vacations for which the participant is entitled in particular to the rights defined in paragraph 11 below. The participant acknowledges that he or she has read and accepted them before confirming his or her booking.

Any booking for a tour package may be made:

The booking must be accompanied by a down payment of 30% of the total price of the tour per participant (100% less than 45 days from the start of the tour).

Payment may be made by bank transfer.

For any booking request, reception of an email from COL CYCLING ADDICTION confirms that the booking and deposit have been accepted.

If the booking cannot be confirmedby COL CYCLING ADDICTION, as a result in particular of lack of availability, all money paid will be fully reimbursed with no charge. In compliance with article L.121-21-08 of the Consumer Code (code de la consommation), as soon as the booking has been validated on the web site, the participant can no longer enjoy a withdrawal period.

The participant must imperatively pay the balance of the price of the tour at the latest 45 days before the start date. Given the special nature of the tours offered by COL CYCLING ADDICTION, a minimum number of participants may be fixed. In that case the number is clearly stated in the technical information for the tour. The booking is taken with the condition precedent that the minimum number of participants is reached.

Pre-constituted group tours may be subject to special conditions of sale that supplement and/or modify these terms and conditions. These special terms and conditions will be attached to the proposals for this type of tour.

Booking must be made in the full name of the participant as it appears on his or her passport or on the identity document used for the tour.

1.2 Minors

Any minors must be registered in the same booking as a responsible adult. Bookings for minors must be signed by the parent(s) exercising parental authority and/or guardian specifying "agreement of the father, mother...". For the tour, the minor must be in possession of all the necessary documents.

The minor remains under the responsibility of the person holding parental authority throughout the stay, regardless of the activities carried out, despite the presence of a guide or supervising staff. COL CYCLING ADDICTION cannot be held liable in the event of a lack of supervision. If the minor travels without his or her parents, the contact details of a contact must be communicated to COL CYCLING ADDICTION before departure.

1.3 Physical fitness

The participant must ensure that his or her physical condition is up to the standard required for the intended tour. COL CYCLING ADDICTION cannot be held responsible in the event of inadequate physical fitness becoming apparent during the stay. COL CYCLING ADDICTION reserves the right not to accept a participant who does not meet the fitness criteria specified for information purposes in the technical data featuring on the site and to refuse to allow the participant to continue his or her stay if this would be dangerous both for him/herself and for the other members of the group; if this situation should arise the participant would not be able to contest the decision taken by COL CYCLING ADDICTION or request any compensation or reimbursement on this account.

1.4 Administrative and health formalities

It is the responsibility of each participant to ensure before departure that he/she is in compliance with police, customs and health formalities (passport, visa, vaccination certificate), and to respect these formalities during the stay. No refund of the price of the tour will be made if the participant is unable to depart due to non-compliance with these formalities.

1.5 Safety and security

It is the responsibility of each participant to read and comply with the safety instructions issued by the local authorities and the recommendations to travellers made by the Ministry of Foreign Affairs on the www.diplomatie.gouv.fr website. As this information may change between booking and the date of departure, it is strongly recommended to consult it regularly.

2 Prices and payment terms

2.1 Price of the tour

All prices are indicated in euros including taxes. What the price includes and does not include is indicated in the technical information of the tour. The rates applied are those in force at the time of booking and are indicated on the website. The total price of the tour, including any supplements requested by the participant, is communicated for agreement, then mentioned on the invoice.

2.2 Procedures for price changes

The price of the tours is firm, final and in euros. However, in accordance with the provisions of Article L211-12 of the French Tourism Code, the price may be revised upwards or downwards up to 20 days before the departure date without the possibility of cancellation/resolution by the participant, for one or both of the following reasons:

- changes in the cost of transport linked in particular to the cost of fuel;

- changes in the rates of taxes or charges on travel services included in the contract imposed by a third party not directly involved in the performance of the contract, including tourist taxes, landing or boarding taxes in ports and airports.

Any variation in the above economic data greater than 25 euros will be fully passed on to the price of the stay. For customers already booked, this change will be notified at the latest 20 days before departure. Customers are then required to pay this supplement. Refusal will be considered as a cancellation/resolution by the customer(s) and will result in the application of the cancellation conditions below.

As part of special offers organized by COL CYCLING ADDICTION, rates may be modified for promotional purposes. Customers booked for a stay, prior to a special offer, will not be able to claim and benefit from its advantages.

2.3 Methods of payment

The amounts to be paid for the stay (down payment and then balance of the price for a booking more than 45 days before the start of the tour, or total price for any booking less than 45 days before departure) are to be paid by bank transfer to COL CYCLING ADDICTIONs account as indicated on the book form or by cheque issued by a French bank.

The balance, including additional services, insurance and assistance, is payable 45 days before departure. If the balance is not paid 45 days before departure, COL CYCLING ADDICTION may cancel the booking without compensation and will apply the cancellation fees mentioned in article 4. In the event of booking less than 45 days before departure, the full price of the stay must be paid at the time of booking. For any payment whose amount is validated and collected by COL CYCLING ADDICTION, an invoice will be sent to the person who signed the booking form.

3 Assistance and Cancellation Insurance

It is essential to have insurance covering in particular: emergency, search and rescue and repatriation during the stay, medical expenses.

It is also advisable to have insurance against cancellation, luggage theft, etc..

COL CYCLING ADDICTION offers each participant the opportunity to take out an Assistance contract as well as a Cancellation contract.

If the customer chooses to take out one of these insurance packages, the notice detailing all the cover and the terms and conditions for reporting the claim (available on the website) will be sent to him or her when confirming booking. The participant is solely responsible for compliance with the procedures for reporting any claim. The participant must therefore keep this agreement with him/her during the tour.

If the client already has insurance covering emergency, repatriation and medical expenses, the contact details and a certificate of his or her contract must be communicated to COL CYCLING ADDICTION at the time of booking.

Insurance offered by COL CYCLING ADDICTION:

Multi-risk” insurance (AVA TOURIST CARD) including trip cancellation, repatriation assistance, search and rescue expenses up to €4,000, medical expenses, loss, theft or damage of luggage, personal liability, individual accident.

Cost 5% of the price (incl. tax) of the tour, with a minimum premium of 70€.

  • Cancellation insurance (AVA ZAP VOYAGE). The insurance covers cancellation of the tour (cancellation during the last 30 days before departure, according to the SNAV scale).

Cost 3.5% of the price (incl. tax) of the tour with a minimum premium per person of 40 €.

  • Health assistance insurance (AVA CARTE SANTE), covering medical expenses, repatriation and assistance (with search and rescue costs up to 4000 €) and personal liability.

 Cost 5€ per day (for a tour of up to 14 days).

 No changes will be possible once the insurance has been purchased.

3.1 Multi-risk assistance

Assistance contract including the following guarantees:

  • Repatriation assistance;
  • Medical and hospitalization expenses;
  • Cancellation or modification of the trip;
  • Loss, theft or damage of luggage;
  • Interruption of stay, baggage delay, flight delay;
  • Death and disability benefit;
  • Personal liability abroad.

3.2 Cancellation insurance

Cancellation contract including the following guarantees:

  • Trip cancellation and modification;
  • Reimbursement of cancellation fees to be paid by the participant;
  • Any unpredictable event, including relapse or aggravation of a previous disease.

3.3 Medical insurance

Health assistance contract including the following guarantees:

  • Medical and hospitalization expenses abroad;
  • Emergency dental care;
  • Repatriation;
  • Early return;
  • Search and rescue costs;
  • Personal liability abroad.

The Assistance and Cancellation contracts take effect upon subscription. On that date, the amount of the insurance premium is no longer refundable.

4 Changes requested by the customer

4.1 Cancellation

Whatever the reason, the customer must notify COL CYCLING ADDICTION immediately and confirm the cancellation by registered letter or e-mail with acknowledgement of receipt. The date of receipt of the registered letter or e-mail will be the date used to calculate the amounts withheld.

COL CYCLING ADDICTION reimburses the full price of the stay after deduction of the following cancellation fees (per person):

  • More than 60 days before departure: 5% of the price of the tour with a minimum of 50€;
  • From 60 to 31 days before departure: 15% of the price of the tour with a minimum of 100€;
  • From 30 to 21 days: 35% of the price of the tour;
  • From 20 to 14 days: 50% of the price of the tour;
  • From 13 to 7 days: 75% of the price of the tour;
  • Less than 7 days before departure: 100% of the price of the tour.

If the cancellation insurance contract has been taken out, it will apply for the reasons provided for in the contract, after examination of the supporting documents by the insurer. Cancellation of the stay does not exempt the participant from full payment of the stay; any procedure for reimbursement by the insurance company can only be initiated on this condition.

4.2 Change or modification of the stay at the participants request

More than 45 days before departure, if a participant wishes to change the tour or modify the dates or additional services of a tour, the participant must pay a minimum amount of 50€ per application. Any modification will be subject to COL CYCLING ADDICTIONs prior agreement and will be subject to availability. Less than 45 days before departure, any change may be considered as a cancellation and result in the application of the above cancellation conditions.

4.3 Modification during the stay at the request of the participant

Any modification of the programme made at the participants request (extension, modification of accommodation, etc.) can only be implemented with the agreement of COL CYCLING ADDICTION and will be subject to availability and payment of related costs by the participant.

4.4 Interruption of stay

Any stay interrupted by the participant’s decision (for health reasons, for reasons of technical ability or physical fitness or for any other reasons) will not result in COL CYCLING ADDICTION refunding any unused services. Any additional costs incurred by the participant as a result of this will not be reimbursed.

5 Modification on the part of COL CYCLING ADDICTION

5.1 Due to insufficient number of participants

If the minimum number of participants is not reached, the tour may be cancelled at the latest 20 days before departure without COL CYCLING ADDICTION being required to pay any compensation or indemnity to the participant. In this case, the customer is informed by e-mail or telephone. The customer then has the choice between the following options:

- Full refund of the sums paid;

- Carry forward up to the amount of the sums paid for another stay of his or her choice.

An alternative solution may be proposed. In the event that the proposed alternatives are not suitable for the participant, the payments will be returned in full, without further compensation. All costs incurred by the participant remain at his or her own expense (purchase of transport tickets, hotel, equipment necessary for the stay, administrative costs).

5.2 Due to force majeure

Events constituting force majeure (unforeseeable and insurmountable incidents or events such as: wars, political unrest, strikes, riots, weather conditions, natural disasters, etc.) may require cancellation of the stay. In this case, the customer is informed immediately by e-mail or telephone. The customer then has the choice between reimbursement or deferral up to the amount of the sums paid for another stay of his or her choice; he or she cannot then claim any compensation.

5.3 Modification of the tour

Before departure, programme changes (dates, schedules, itineraries, supervision, accommodation, etc.) may occur due to organizational difficulties or security issues. Each participant is then informed by COL CYCLING ADDICTION. If this change affects an essential element of the program, the participant has the option either to terminate the contract without claiming any compensation or to accept the change proposed by COL CYCLING ADDICTION. The presence of the participant at the start of the tour implies acceptance of the changes.

During the tour, modifications to the programme (dates, schedules, itineraries, supervision, accommodation, swapping stages, etc.) may occur due to organizational difficulties, weather reasons or for security reasons. If COL CYCLING ADDICTION is able to do this, replacement services are offered to the participant. Failing this, and except in the event of force majeure, COL CYCLING ADDICTION will refund the difference in price between the services provided and those scheduled.

5.4 Interruption of stay

Any tour may also be interrupted by decision of COL CYCLING ADDICTION for duly justified reasons. In this case, unless the interruption is due to force majeure, COL CYCLING ADDICTION will refund the difference in price between the services provided and those scheduled.

6 Liability

6.1 Personal liability

In accordance with articles L211-18 and R211-35 to R211-40 of the Tourism Code which governs our profession, COL CYCLING ADDICTION is insured for Professional Liability up to 30,000 € per year of insurance. The contract was signed with MMA IARD SA, whose registered office is located at 14 boulevard Marie and Alexandre OYON 72030 LE MANS CEDEX 09, under contract number 145 083 826.

However, COL CYCLING ADDICTIONs liability does not replace the individual liability which is the responsibility of each participant.

6.2 Liability and risks involved

In accordance with the provisions of article L211-16 of the French Tourism Code, COL CYCLING ADDICTION cannot be held liable in the event of non-performance or improper performance of the contract attributable either to the buyer or to the unforeseeable and insurmountable actions of a third party outside the scope of the services provided in the contract, or to a case of force majeure.

COL CYCLING ADDICTION may not be held liable in particular in the event of:

  • Failure to submit valid administrative and health documents;
  • Loss by the participant or theft of airline tickets;
  • Wars, political unrest, strikes, technical incidents, bad weather, bad weather, airspace congestion, delays, particularly for security reasons, breakdowns, loss of flight, delays or damage to luggage, bicycles and other items, injunctions from an administrative authority, etc.
  • Incidents occurring during the free time granted to the participant and not provided for in the description, nor pre-routing or post-routing taken at the participants initiative;

In addition, COL CYCLING ADDICTION organizes sports tours, sometimes far from local infrastructures.

Considering the particular character of our stays:

Each participant must comply with the advice given in the technical data, in the road book and, if necessary, by the accompanying persons. Each participant must be aware that he or she may run risks of any kind due to local conditions (poor road conditions, poor means of communication, distance from medical centres, etc.). He or she assumes them in full knowledge of the facts and undertakes not to hold COL CYCLING ADDICTION liable for them. Similarly, COL CYCLING ADDICTION cannot be held responsible for the individual recklessness of one or more participants.

COL CYCLING ADDICTION reserves the right to exclude, at any time, one or more participants whose behaviour would endanger the safety of the group or its well-being, without any compensation being due to the participant.

COL CYCLING ADDICTION cannot be held responsible for changes in schedules or itineraries caused by circumstances beyond its control. In such conditions, any delay suffered by the participant as well as the consequences of this delay cannot result in any compensation to be paid by COL CYCLING ADDICTION. Thus, participants are not entitled to any reimbursement or compensation, in particular due to the modification of the flight dates initially planned or the delay at an air stopover, etc. Any additional costs (taxes, hotel, parking, purchase of tickets, etc.) will remain the responsibility of the participant.

7 Bicycle equipment and rental

Each participant is responsible for his or her own equipment (bicycle, clothing and various accessories) whether he or she owns or rents it. We decline all responsibility in the event of damage to bicycles, falls or theft. In case of rental, a deposit is required and must be paid by credit card. In the event of damage or theft of the rented equipment made available, COL CYCLING ADDICTION reserves the right to collect the amount of the deposit.

Each participant is required to bring a minimum set of clothing for daily mountain road cycling (waterproof clothing, warm clothing, safety equipment...).

Wearing a helmet is mandatory for all participants in trips organized by COL CYCLING ADDICTION, which declines any responsibility in the event of non-use of the recommended safety elements.

8 Transport and Luggage

COL CYCLING ADDICTION cannot be held liable in the event of routing difficulties, particularly air transport difficulties.

Baggage: During the stay, baggage may be transported by various means (vehicles, towed trailer) and must be adapted to these conditions. COL CYCLING ADDICTION will not pay any compensation in the event of deterioration. Each participant is required to keep the valuables with him or her at all times and under his responsibility. Each participant must ensure that their luggage is present when organising transfers.

9 Image rights

During stays, COL CYCLING ADDICTION may use photographers/video makers or take photos/videos itself. COL CYCLING ADDICTION reserves the right to use these photos/videos for promotional purposes on its brochures, posters, websites, social networks, without this list being exhaustive. The participant also authorizes COL CYCLING ADDICTION to use his or her first name, image, brands, opinions and comments without this list being exhaustive, in order to be reproduced and distributed online on the website www.col-cycling-addiction.com, for promotional, bibliographic and/or information purposes (section "Testimonials").

Nevertheless COL CYCLING ADDICTION guarantees that it will not take or use any image that could be degrading or harmful to the participant.

In the event that a participant refuses the use of his or her name, image, brands, opinions and comments, he or she must make a request to COL CYCLING ADDICTION at the time of registration.

10 Disputes

10.1 Complaint

Any claim relating to the tour must be addressed by the participant to COL CYCLING ADDICTION, 4930 Route des Pindats 64290 BOSADRROS (France) by registered letter with acknowledgement of receipt, at the latest 1 month after the date of return, accompanied by all the supporting documents. If there is no satisfactory response within one month, the participant may refer the matter to the Tourism and Travel Mediator.

10.2 Disputes

Subject to the defendants status, any dispute comes under the exclusive competence of the PAU Commercial Court.

11 Travellers rights

The combination of travel services offered to you is a package within the meaning of Directive (EU)2015/2302 and Article L.211-2 ll of the Tourism Code. You will therefore benefit from all the rights granted by the European Union applicable to packages, as transposed in the Tourism Code. COL CYCLING ADDICTION will be fully responsible for the proper execution of the package as a whole.

In addition, as required by law, COL CYCLING ADDICTION has protection to refund your payments and, if transportation is included in the package, to ensure your repatriation in the event that it becomes insolvent.

12 Confidentiality and personal data 

In accordance with Article 5 of the European Regulation 2016/679 on the collection and processing of data: We limit the collection of your personal data to what is strictly necessary (such as surname, first name, e-mail address, telephone number, postal address, date of birth...) and apply a principle of transparency: no information is collected without your knowledge. 

The collection of this data enables COL CYCLING ADDICTION to manage your registration or information request. This data is collected when the user carries out one of the following operations on the site: registration for a trip and submission of a notice, request for a quote or contact, subscription to the newsletter, request for dates and prices, request for a brochure.  COL CYCLING ADDICTION may, for the purposes of the Tours, be required to transmit this data to its service providers (hotel owners, bike rental, insurance company, transporters, etc.).
Clients have the right to access, modify, rectify and delete their personal data (art. 38 et seq. of the modified Law of 8.01.1978) that COL CYCLING ADDICTION has collected.
